Town of Mammoth Lakes New Woodstove Insert Requirements

Are you aware that the Town of Mammoth Lakes recently passed a new ordinance requiring that all wood-burning stove inserts be upgraded?  And are you aware of how this will affect you if you are considering purchasing or selling a home or condominium in Mammoth?

On March 20, 2013, the Town of Mammoth Lakes Town Council passed Ordinance Number 15.04.140, which states that “a minimum of 48 inches vertically of non-combustible material shall be installed within the chase area measured from the top of the existing pre-fabricated metal firebox.  A minimum of 24 inches horizontally of non-combustible material shall be installed within the chase area measured from the edge of the woodstove insert.”  In addition, modifications to the flue and the flue pipe could be required.

For all escrows opened on or before June 30, 2013, these upgrades will have to be completed by October 31, 2022.  For all escrows opened AFTER June 30, 2013, these upgrades will have to be completed within 60 days of the sale of the property!    This new code will be enforced by both Town building officials and the Fire Marshall.

So what does this mean for you as someone who is planning on buying or selling property here in Mammoth Lakes, and how will these costs be allocated??

  • SELLERS:  The cost of this mandated upgrade is estimated at around $6,000.  However, that cost could vary widely depending on the materials and skill level required to reconstruct the area surrounding the fireplace.  Like other government mandated upgrades (such as upgrading to an EPA insert), this cost, or at least part of this cost, is likely to be factored in to any offer presented by a buyer.   If you can sell your property before June 30th, it’s likely that the buyer will be willing to share in these costs because they will have nearly ten years in which to complete the upgrade.  After June 30th it’s likely to be a different story since the buyer will need to complete the upgrade within 60 days.  If you are considering listing your property for sale, NOW is the time to do it! 
  • BUYERS:  If you are considering buying a home or condominium here in Mammoth, I cannot stress enough the importance of making an offer before June 30th!  After that date, even if you are able to negotiate a full credit for the estimated cost of upgrading with the seller, you will be responsible for making sure your wood burning insert is compliant with the new code within 60 days.  Not only will this be expensive, but if you’ve ever worked with contractors here in the Eastern Sierra, you know it will also be a hassle that could prevent you from fully enjoying your new mountain home.  By securing a property before June 30th, you will be able to put off upgrading your stove for nearly ten years.  Wouldn’t it be nice to put some of that money/time into making other upgrades to your new property?
